These Terms and Conditions apply to purchases made through wafflemix.com.au (“Website”), operated by EZ WAFFLE(“we”, “us” or “our”).
By using this Website or placing an order, you agree to these Terms and Conditions.
1. Products
EZ WAFFLE supplies waffle mix, waffle machines, waffle plates and related products, primarily to cafés, restaurants, food trucks, catering businesses and other commercial customers.
We make reasonable efforts to ensure that product descriptions, images, specifications and other information on the Website are accurate. However, minor variations in appearance, packaging or specifications may occur.
Customers are responsible for ensuring that products purchased are suitable for their intended use.
2. Orders
When you place an order through the Website, you are offering to purchase the products selected at the price displayed at checkout.
An order is accepted when we confirm the order and/or receive payment.
We reserve the right to decline or cancel an order where a product is unavailable, there is an error in pricing or product information, payment cannot be processed, or we reasonably suspect fraudulent or unauthorised activity.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
3. Prices and GST
All prices displayed on the Website are in Australian dollars (AUD) and are exclusive of GST, unless otherwise stated.
Applicable GST is added to the order total at checkout.
We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.
4. Payment
Payment must be made using the payment method available at checkout or otherwise agreed with us.
Online payments are processed through Stripe. Other payment methods may be made available from time to time.
Where an offline payment arrangement has been agreed with a customer, payment must be made according to the agreed terms.
We may delay dispatch of an order until payment has been received.
5. Returns, Refunds and Faulty Products
Our Refund and Returns Policy explains our procedures for defective, faulty, damaged or incorrect products and any applicable returns or refunds.
Nothing in our Refund and Returns Policy or these Terms and Conditions limits any rights you may have under the Australian Consumer Law.
6. Waffle Mix
Waffle mix is a food product and should be stored, prepared and used in accordance with the instructions and information provided on the product packaging.
Customers are responsible for checking ingredient and allergen information before using the product.
Where a customer uses EZ WAFFLE products to prepare food for sale to its own customers, the customer is responsible for the preparation, handling, storage and sale of that food and for complying with applicable food safety requirements.
7. Waffle Machines and Waffle Plates
Waffle machines and waffle plates must be used in accordance with the manufacturer’s instructions and any safety information supplied with the product.
Customers are responsible for appropriate installation, operation, cleaning and maintenance of equipment.
Damage resulting from misuse, improper installation, unauthorised modification, neglect, incorrect cleaning, failure to follow manufacturer’s instructions or normal wear and tear may not be covered by a manufacturer’s warranty.
Any manufacturer’s warranty provided with a product is additional to any rights available under the Australian Consumer Law.
8. Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law applies, our products come with guarantees that cannot be excluded.
9. Intellectual Property
All content on the Website, including text, photographs, logos, graphics, product descriptions and other materials, is owned by or licensed to EZ WAFFLE unless otherwise stated.
You must not reproduce, copy, modify, distribute or commercially use our Website content without our prior written permission.
10. Website Use
You must not use the Website for any unlawful purpose or in a way that may damage, disable or interfere with the Website or its security.
You must provide accurate information when placing an order or creating an account.
We may suspend or restrict access to the Website where reasonably necessary to protect our Website, business or customers.
11. Limitation of Liability
To the maximum extent permitted by law, EZ WAFFLE is not responsible for loss or delay caused by circumstances beyond our reasonable control.
